The High Court has directed four murder suspects to undergo mental assessment over the murder of Dr. Victoria Mutiso.
The court also notified four individuals, including Rose Mbithe Mulwa, her two children, and police officer Elijah Kibelion, of the murder charge they are facing in connection with the killing of Dr. Victoria Nthunya Mutiso.
However, the suspects have not taken plea pending the completion of psychiatric assessments.The suspects were separately presented before the High Court at Milimani, where the prosecution formally communicated the charge of murder to them on behalf of the Director of Public Prosecutions.
Rose Mbithe Mulwa, also known as Rose Mbithe Ndetet, together with her children Chris Mulwa and Angela Mulwa, were informed that the prosecution intends to charge them with the murder of Dr. Victoria Nthunya Mutiso.
The charge sheet states that the three, jointly with others not before the court, are alleged to have murdered Dr. Mutiso on the morning of July 29, 2026, at about 9:30 a.m. along Mawensi Road in Kilimani Sub-County, Nairobi County.
Presiding over the proceedings, Justice Kanyi Kimondo directed that the accused persons should not be called upon to plead to the murder charge until they undergo psychiatric assessment at Mbagathi Hospital.
The court subsequently set September 23, 2026, as the date when the accused persons are expected to formally answer to the charges before Justice Alexander Muteti.
Meanwhile, the court declined an application by the defence seeking to have Rose Mbithe Mulwa and Angela Mulwa held at a police station, as efforts continued to expedite a related civil dispute over contested property.
The two were instead ordered to be remanded at Lang’ata Women’s Prison.Chris Mulwa and police officer Elijah Kibelion were directed to be held at Nairobi Remand Prison pending further directions from the court.
The court further directed that a pro bono advocate be appointed to represent Kibelion during the criminal proceedings.
Dr. Victoria Nthunya Mutiso is alleged to have been murdered on July 29, 2026, along Mawensi Road in Kilimani, Nairobi.
The prosecution has subsequently preferred a murder charge under Section 203 as read with Section 204 of the Penal Code.
The charge sheet before the court lists Rose Mbithe Mulwa alias Rose Mbithe Ndetet, Chris Mulwa, and Angela Mulwa as accused persons, and alleges that they committed the offence jointly with others not before the court.
The four suspects will remain in custody as they await psychiatric assessment and the next court appearance. They are expected to take plea on September 23, 2026, when the matter comes before Justice Alexander Muteti for formal plea-taking.
