A nominated Makueni Member of County Assembly, Urbanus Kyalo Wambua, has been granted a bond of Ksh.500,000 or an alternative cash bail of Ksh.200,000 by the Milimani Law Courts in a cyber harassment case involving Kibwezi west member of Parliament Mwengi Mutuse.
Appearing before Presiding Magistrate Joan Marti on 13th August, 2026, Wambua was ordered to deposit the bond or pay the alternative cash bail as he awaits further proceedings in the matter.
Wambua is charged with cyber harassment contrary to Section 27(1)(a), as read with Section 27(2)(1) of the Computer Misuse and Cybercrimes Act.
The charge relates to a TikTok video allegedly posted on August 5, 2026, in which he is accused of making remarks concerning Kibwezi West MP, Mwengi Mutuse.
The prosecution alleges that the communication was intended, or ought to have been known, to cause Mutuse fear of violence.
Appearing for the Republic, Victor Owiti told the court that the prosecution was not opposing the accused’s release on bond.
However, he urged the court to consider the circumstances surrounding the arrest and argued that the alleged abuse of computer misuse laws by politicians should be treated as an aggravating factor.
Owiti further submitted that the issue of free bail should not automatically apply in the matter, arguing that the Ksh.50,000 police cash bail already granted should not determine the terms to be imposed by the court.
Wambua was represented by Makueni senator, Dan Maanzo, Boniface Nyamu and Jackson Kala who urged the court to grant him reasonable bond terms.
They argued that the complaint had been lodged by the Kibwezi West MP and described the case as a political matter.
They maintained that Wambua was not a flight risk, had a known place of abode and was already out on a Ksh.50,000 police bond.
They further told the court that he had been arrested in Makueni and that the charges were purely political.
The charge sheet indicates that Wambua was arrested without a warrant on August 6, 2026 and was granted Ksh.50,000 cash bail.
Hearing from both sides, the court fixed August 24th, 2026, for mention and pre-trial directions.
The nominated MCA will therefore remain out of custody upon depositing the Ksh.500,000 bond or paying the alternative cash bail of Ksh.200,000, pending further proceedings.
