Two siblings accused of acquiring and using proceeds of crime in a fraud case involving more than 103 million shillings have been granted a Sh10 million bond each by a Milimani court.
The Chief Magistrate ordered the accused to either deposit a Sh10 million bond or pay a cash bail of Sh3 million each.
Appearing at the Milimani law court on September 2, 2026, the accused through their lawyer argued that the siblings are not a flight risk, noting that their known residence in Kakamega could easily be traced.
The defence also told the court that the case is linked to another matter pending before Court Number 5, involving a third sibling facing related charges.
The defence further disputed claims that the accused had evaded arrest, saying they were arrested without resistance and had cooperated with the investigating officer.
The lawyer also urged the court to expedite the matter and assign a dedicated investigating officer to facilitate the conclusion of investigations.
The prosecution, however, opposed lenient bail terms, arguing that the accused had previously been summoned but failed to present themselves before investigators.
The State told the court that they were eventually arrested near the Uasin Gishu County border.
Prosecutors further argued that the alleged fraud involves more than Sh103 million and asked the court to impose bond terms similar to those in the related case a Sh10 million.
In response, the defence maintained that their clients had never been served with any official court or police summons and insisted that they had fully cooperated once arrested.
After considering submissions from both sides, the Chief Magistrate granted each accused a Sh10 million bond or a cash bail of Sh3 million.
The case will return to court on October 6, 2026, for pre-trial directions.
