The High Court in Nairobi has issued an interim order staying the execution of a judgment and orders issued by the National Transport and Safety Authority (NTSA) against Nicco Movers Limited, pending further directions in the matter.
The order was issued by High Court Judge Janet Mulwa in a case pitting Nicco Movers Limited against the National Transport and Safety Authority (NTSA) and Jacinta Nzijilani Mutuku.
The matter came before the court on September 2, 2026, for directions on a Notice of Motion dated September 1, 2026.
After considering the application, the supporting affidavit and the judgment of the NTSA delivered on August 31, 2026, Justice Mulwa certified the motion as urgent and directed that it be served within 24 hours of the order.
The respondents have also been directed to file their responses within seven days.
Most significantly, the court invoked its powers under Section 3A of the Civil Procedure Act and granted an interim order staying the execution of the NTSA judgment and orders.
The stay will remain in force until September 22, 2026, when the parties are expected to return to court for further directions on the disposal of the motion.
The High Court has therefore temporarily halted the enforcement of the NTSA judgment and orders against Nicco Movers Limited, with the matter now scheduled for further directions on September 22, 2026.
The court has cautioned that disobedience or non-observance of its order will attract penal consequences.
