Nakuru Court has on 24th June 2026 issued a conservatory protection order against a Nakuru family involved in a protection case.
The application was filed by Sarah Nyokabi, with former Nairobi Governor Mike Mbuvi Sonko acting as an interested party. Nyokabi sought protection from abuse and domestic violence caused by the accused, Edwin Muthomi Kaunga.
In her application, Sarah Nyokabi requested the court to certify the matter as urgent and to issue an interim protection order against Edwin Muthomi Kaunga, either personally or through his agents or servants.
The order would restrain him from harassing, tormenting, intimidating, or threatening her and her family.
Nyokabi also sought the intervention of the Officer Commanding Nakuru Police Station to oversee and ensure enforcement of these orders.Edwin Muthomi Kaunga is accused of murdering Ann Mugweru, contrary to Sections 203 and 204 of the Penal Code.
Sarah Nyokabi, being the sister of the deceased, is a direct victim of the alleged crime.Since his detention, Edwin has been threatening, harassing, and intimidating Nyokabi and her family.
He has been using a phone number from prison to contact family members, threatening that he will come for the deceased’s child and for Sarah herself. These threats are made in a threatening tone, causing the family to fear for the safety of the minor.
Although the family is unsure of the true owner of the phone number, the caller identifies himself only as Edwin, the Respondent. The same number has been used to contact individuals such as John Mutegi and George Kimani.
The family’s fear is that unless the court intervenes, these threats and acts of intimidation will continue, potentially leading to harm.
After reviewing the Notice of Motion application dated 22nd June 2026, filed under various sections of the Civil Procedure Act, the court recognized the urgency of the matter to safeguard the safety and dignity of the applicant.
It ordered that an interim protection order be issued, restraining the Respondent, either personally or through agents, from harassing, tormenting, intimidating, or threatening Sarah Nyokabi and her family until the case is fully heard and determined.
The Nakuru Police Station Officer Commanding Station (OCS) is directed to oversee and enforce compliance with this order.
The applicant is required to serve the application and the court order on the Respondent and, if applicable, any Interested Party within three days.
Upon service, the Respondent and Interested Party are to file and serve their responses within fourteen days.
