The two, Abdi Yunis Abdullahi and Abdullahi Abdi Ibrahim, who are linked to an alleged KSH 1.5 million milk fraud, appeared before principal magistrate Carolyne Nyaguthii on 7th May 2026, where investigators sought a 10-day custodial order.
The DCI, through Investigating Officer Corporal Opili Edgar, told the court that the duo was under investigation for allegedly obtaining 1,100 cartons of packed milk valued at approximately KSH 1,518,000 by false pretenses.
The prosecution urged the court to grant a 10-day custodial order, arguing that investigations were still ongoing and required additional time to trace the goods, verify identification documents, and record further statements.
The State further submitted that the respondents posed a flight risk if released before the investigations were finalized.
However, the 1st Respondent, Abdi Yunis Abdullahi, opposed the application and pleaded with the court to either reduce the detention period to two days or admit them to cash bail.
He informed the court that he was born in Garissa in 1996, is a Kenyan citizen with a fixed place of abode, and therefore had no intention of absconding court process.
He further stated that he suffers from chronic asthma, while his co-accused was also unwell, arguing that prolonged detention in police custody would negatively affect their health conditions.
In her ruling, Nyaguthii held that while the allegations before the court were serious and investigations needed to be concluded, the 10-day period sought by the prosecution was excessive in the circumstances.
The court consequently granted the Investigating Officer three days to detain the respondents at Kamukunji Police Station pending completion of investigations.
The court further directed that the suspects be accorded proper medical attention during their detention owing to the health concerns raised before court.
The matter will be mentioned upon lapse of the custodial period for further directions as the DCI finalizes investigations into the alleged fraud.
