Former Kiambu Governor Ferdinand Waititu, his wife Susan Wangari and two co-accused have pleaded for mercy ahead of sentencing on three money laundering counts linked to a Sh588 million road construction tender.
Appearing before Milimani Anti-Corruption Chief Magistrate Harrison Baraza on October 27, 2026, the four, through lawyer Chris Mutuku, cited years of court proceedings, emotional distress and loss of freedom, asking the court to consider their circumstances before determining their punishment.
The defence said the accused had endured anxiety and sleepless nights since the case began in 2019.
Although they maintain their innocence, they acknowledged that the convictions currently stand.
Mutuku also sought leniency for Beth Wangeci Mburu, wife of co-accused Charles Chege, arguing that she played a limited role in the company and only signed its initial registration documents.
He said a harsh sentence against both parents could leave their children without adequate parental care.
The defence further argued that no government money was lost and that the contracted works were completed, maintaining that the dispute centred on how the tender was awarded.
The case stems from allegations that Kiambu County irregularly awarded Testimony Enterprises Limited a Sh588 million contract in the 2017/2018 financial year to upgrade gravel roads in Thika, Limuru, Gatundu North, Juja and Ruiru.
The High Court overturned the accused persons’ earlier acquittals on the money laundering counts in October 2026, paving the way for sentencing.
The court is expected to deliver its sentencing ruling on November 2, 2026.
