
A legal battle is looming between Advocate Danstan Omari and Cape Media Limited, the owners of TV47, after the lawyer issued a demand letter accusing the media house of publishing defamatory statements against him.
Through Wambui Shadrack & Associates Advocates, Omari is demanding an unconditional public apology, removal of the publication and Ksh100 million in compensation over a YouTube video published on July 12, 2026.
According to the demand letter dated July 13, 2026, Omari takes issue with a TV47 Kenya YouTube video titled “TV47 stands by Exposé as Prophet Owuor’s church seeks its removal.”The advocates argue that the publication referred to Omari as a “self-proclaimed advocate,” a description they say was false, malicious and defamatory.
They contend that the statement was intended or made with reckless disregard, to injure his personal integrity, professional reputation and standing in society.
The letter states that the publication falsely portrayed Omari as someone who had “falsely assumed the status of an Advocate of the High Court of Kenya,” and alleges that the words implied he lacked the academic and professional qualifications required to practise law, had deceived clients and judicial officers, and was an impostor masquerading as an advocate.
To counter the allegations, the advocates state that Omari obtained his Bachelor of Laws degree from the University of Nairobi in 2008, joined the Kenya School of Law in 2009, was admitted to the Roll of Advocates on November 4, 2011, holds a valid practising certificate under the Advocates Act and later obtained a Master of Laws degree.

The demand letter argues that these credentials are matters of public record and that a simple verification would have established his professional status.
The advocates further claim that the publication has subjected Omari to embarrassment, ridicule and reputational harm, stating that he has received numerous inquiries from clients, fellow advocates, judicial officers, former students and members of the public seeking clarification over the claims.
They also state that the publication has been widely shared on social media, causing injury to both Omari and his law firm, Danstan Omari & Associates Advocates.
According to the letter, the allegedly defamatory publication had, as of the afternoon of July 13, 2026, attracted approximately 15,000 views, 281 likes and numerous comments on TV47 Kenya’s YouTube platform, with the advocates arguing that the continued availability of the video amounts to a continuing wrong that aggravates the alleged injury.
The lawyers demand that TV47 immediately remove the video from all its platforms, publish a “full comprehensive, unequivocal and unconditional apology” acknowledging that Omari and the other advocates are duly admitted and practising advocates of the High Court of Kenya, issue a written undertaking not to republish similar statements, and compensate Omari Ksh100 million for the alleged damage to his reputation, dignity and legal practice.
The demand letter gives Cape Media Limited two days to comply, warning that failure to issue an unconditional apology, retract the statements and compensate the advocate will result in court proceedings being instituted against the media house without further notice.
