
Two men, including a former principal of Merishaw School, have been released on a personal bond of Ksh100,000 each after appearing before the Milimani Law Courts.
The accused, David Gideon Kariuki and Alex Kasaine Kataiyo, were arraigned before Magistrate Daisy Mutai on charges linked to the 2025 Kenya Certificate of Secondary Education (KCSE) examinations held at Merishaw School in Isinya Sub-County, Kajiado County.
However, the two did not take plea as the state counsel asked for more time, she told the court that the DPP was reviewing the charges against the accused persons. “We therefore request a period of 60 days in which we will update the court on the plea bargain agreement and whether to drop the charges or not”
Court documents allege that they, along with others, disclosed examination materials improperly during the tests.
They face a count of disclosing exam content without lawful authority, contrary to Section 28(b) of the Kenya National Examinations Council (KNEC) Act, Cap 214A. Additionally, they are charged with conspiracy to commit a felony under Section 393 of the Penal Code.
According to court documents seen by kauntinews.com, the pair allegedly shared English Paper 1 examination content with candidates on November 3, 2025, during the national exams.
The case arises from investigations prompted by reports of irregularities at the Merishaw School Examination Centre during the 2025 KCSE.
Authorities allege that examination materials were illegally circulated, and the CCTV security system at the center was tampered with to facilitate malpractice and avoid detection.
Between November 2 and 3, 2025, investigators claim that the accused conspired with others to interfere with the surveillance system, enabling the illegal sharing of exam information.
The investigation also indicates attempts to project false examination details by manipulating security footage.
During court session, defence counsel noted that the accused had cooperated with investigators since the investigations began last year.
They requested that the court release them on a free bond while further proceedings are awaited. The prosecution did not oppose this request.
Magistrate Daisy Mutai deferred plea-taking and ordered the release of David Gideon Kariuki and Alex Kasaine Kataiyo on bonds of Ksh100,000 each.
