Three Persons Accused of Conspiracy to Defraud Released on KSH 1.5M Bond
While appearing at the Milimani Law Court on 16th December 2025, the accused, Jane Gitau, Eric Mwaura, and Benjamin Githara, were released on a bond of KSh 1.5 million plus a surety of a similar amount or a cash bail of KSh 700,000.

The magistrate also directed that the passports of the accused be deposited in court.
The three are charged with conspiracy to defraud contrary to section 317 of penal code. Jane Wangechi Kabiu alias Jane Kabiu Gitau, Eric Mwaura Karugu, and Benjamin Githara Karugu are accused that on or about the 2nd day of May 2012, at an unknown place within the Republic of Kenya, they jointly conspired to defraud Victoria Nyambura Karugu of her shares by transferring one ordinary share from Mathara Holdings Limited to Centurion Holdings Limited.
However, Jane Gitau faces two additional charges, including forgery. Jane Wangechi Kabiu, alias Jane Kabiu Gitau, on an unknown date in 2012 within the Republic of Kenya, with intent to deceive, forged a Share Transfer Form purporting to be a genuine Share Transfer Form of Victoria Nyambura Karugu.
She is also charged with uttering a false document. On an unknown date in 2012, within the Republic of Kenya, she knowingly and fraudulently uttered a false document, namely a Share Transfer Form, purporting to be a genuine Share Transfer Form of Victoria Nyambura Karugu, to the Director-General of Business Registration Services.
Eric Mwaura and Benjamin Githara are further accused of giving false information to a person employed in the public service. On 5th February 2025, at the Directorate of Criminal Investigations Headquarters in Nairobi City County, they informed IP Peter Ouma, an investigator serving with the DCI and a person employed in the Public Service, that they were given Share Transfer Forms to sign, information they knew to be false, thereby causing or knowing it to be likely that it would cause the said Peter Ouma to undertake investigations which he ought not to have done if the information had not been given.
The case will be mentioned on January 20, 2026.
